1. Privacy policy

The protection of your personal data is important to us. DIWISA AG processes your personal data in compliance with Switzerland’s Federal Act on Data Protection (FADP) and other applicable data protection regulations.

This Privacy Policy informs you about the nature, scope and purpose of the collection and use of personal data on our websites (referred to hereinafter as “websites”) by DIWISA AG (referred to hereinafter as “we” or “us”), and provides information about your rights. These rights are governed by the applicable data protection laws. As a result, you may have other rights than those set forth in this Privacy Policy, or certain rights may not be available to you.

The basis for the processing of your data for the purposes listed in this Privacy Policy is the performance of contracts (e.g. in connection with the provision of goods and services or the rendering of newsletter services) as well as our legitimate interest (e.g. in connection with the evaluation of the use of our website for the optimization of our processes and procedures).

3. Data collection from the Websites

3.1 Log files

When you use our websites, information is automatically collected and stored in log files which are transmitted to us by the browser of your end device. This includes:

  • The computer’s IP address and operating system,
  • Browser type, version, language,
  • The name of the owner of the IP address range (as a rule your Internet access provider),
  • Date and time of the server request,
  • The website from which access was provided (referrer URL) with the search term used, if applicable,
  • The status code (e.g. error message),
  • The browser you are using (type, version and language),
  • The transmission protocol used (e.g. HTTP/1.1),
  • Ad ID/advertising ID,
  • Events and event targets set by tags,
  • Subpages and links clicked on.

We collect your personal data in order to optimize our services, processes and procedures, especially in connection with the use of our websites and system security and stability.

3.2 Ordering goods

Via our online shop www.drinkdirect.ch, you can order goods either as a customer with a corresponding customer account or as a guest.

To create a customer account, we need the following data:

  • Salutation
  • First name/surname
  • Company
  • Phone number/email address
  • Date of birth
  • Password

The following data is also collected for ordering goods:

  • Residential address
  • Payment information such as credit card details

We use this data to accept and process orders, provide products and services, process payments and communicate with you about orders.

The data is transmitted via the Internet in an encrypted form via SSL during the order process. Credit card details are not stored by us, but collected and processed directly by our payment service provider.

3.3 Newsletter

If you wish to subscribe to the newsletter offered on our websites, we need you to provide us with an email address. We use the latter for sending the newsletter, for statistical evaluations and for optimizing the newsletter.

In order to optimize the newsletter for you, we measure and analyze how often the newsletter is opened and which links the readers click on (newsletter tracking).

You can object to the receipt of the newsletter at any time (by opting out). You will find an unsubscribe link in every newsletter.

3.4 Contacting us

When contacting us (for example by email), the information you provide is processed for the purpose of responding to the inquiry and in the event that follow-up questions arise. As a rule, this includes the following information:

  • Salutation
  • First name and surname
  • Email address
  • Phone number
  • Content of message

The data is deleted as soon as we no longer need it to process your request or if you ask us to delete it.

3.5 Use of cookies and tracking tools

We use our own and third-party cookies on our websites, including tracking tools. Cookies are small files that are downloaded to your device and stored by your browser. Most of the cookies we use are automatically deleted when you leave our websites. Other cookies remain stored on your device until you delete them. These cookies make it possible to recognize your browser the next time you visit our websites, to analyze your use of the websites, and to present interest-based advertisements to you on social networks, amongst other places.

When using cookies or tracking tools from third-party providers such as Google or Facebook, it is possible that your browser might automatically connect directly to the servers of these third-party providers. We have no control over the scope and further use of the data collected through the use of the tools of these third parties. In this context, it is possible that your IP address in particular will be transferred to servers outside the EU.

In your browser, you can adjust the settings so that you are informed in advance about the installation of cookies and can decide on a case-by-case basis whether to refuse cookies in certain cases or in general, or to completely prevent them. Please note that some features of our websites may not work if you disable the use of cookies.

 

4. Links

Our websites may contain links to third-party sites. We are not responsible for the content and data protection measures on external websites that you can access via the links. Please familiarize yourself with the data protection measures of the relevant websites before leaving them.

5. Forwarding of data to third parties

5.1       Outsourcing

In order to be able to offer you our goods and services, we collaborate with various service providers, e.g.

  • IT service providers, so that we have up-to-the-minute infrastructure at our disposal, as well as for sending newsletters and hosting the online shop www.drinkdirect.ch;
  • Payment service providers for the purpose of processing payment transactions (e.g. financial institutions, payment services) for orders;
  • Logistics companies, e.g. delivery services, so that we can deliver our goods to you;
  • Debt collection service providers or consumer reporting agencies, as far as is necessary for exercising our rights.

The above service providers use your data only in the context of processing orders for us and for our service provision (subject to deviating information in this Privacy Policy).

We transfer data to locations outside Switzerland and the European Union (third countries) only if the recipient country has legislation guaranteeing adequate data protection. If the recipient country does not have legislation guaranteeing adequate data protection, we will disclose your data only if you have consented to this disclosure, if it is necessary for the preservation of overriding interests, or if the security of your data is ensured by the conclusion of contractual guarantees.

5.2       Credit checks

Before a payment method selection list is displayed to you, a pre-authorization procedure including a credit check takes place. In the event of a positive authorization result, “Purchase on account” and “Purchase by installment” will be offered for selection as one of the possible payment options. Your data will be disclosed to Accarda AG, Birkenstrasse 21, 8606 Brüttisellen, Switzerland (which will conduct the authorization process) for address verification and credit check purposes.

For orders placed with the online shop at www.drinkdirect.ch using the payment option “Purchase on account” and “Purchase by installment”, Accarda AG assumes our claim against you within the framework of an assignment of claims (cession). When placing an order as a customer of the online shop of Diwisa Distillerie Willisau SA, you agree that the data associated with the payment method “Purchase on account” and available to the online shop of Diwisa Distillerie Willisau SA, including personal data, purchase data, invoice and payment and debt collection data, can be used by Accarda AG in its capacity as controller for its own purposes; in particular, Accarda AG is authorized to include this data in its own credit checking databases and to use it for other purposes of its own, including the use of credit checking queries for the “Purchase on account”, “Purchase by installment” and “Credit card” means of payment for itself and for third parties (e.g. online shops). For further information on “Purchase on account”, we also refer you to our General Terms and Conditions.

6. Your rights

Insofar as provided for by the data protection law applicable to you, you may request information free of charge about the stored data relating to you, its origin and recipients and the purpose of the data processing. In accordance with the statutory requirements, you also have the right to rectification, deletion, restriction of or objection to processing and to the release of this data for transfer to another body. 

You may withdraw your consent at any time with effect for the future. An informal email to privacy@diwisa.ch is sufficient for this purpose.

Please note that the above rights are subject to statutory restrictions and may impair or make it impossible to provide our services.

You are entitled to enforce your claims in court or to lodge a complaint with the competent data protection authority. The Federal Data Protection and Information Commissioner is responsible for Switzerland (http://www.edoeb.admin.ch).

7. Current version and amendments to this Privacy Policy

We may change or amend this Privacy Policy at any time. The current Privacy Policy can be viewed on our websites.
